Having witnessed my cousins case and the representation provided by Brodie canter and Jackson it was disappointing to see important aspects of the father’s case seemingly not being properly advanced. While it was acknowledged that the relationship between the parents had been unhealthy and toxic, this should not automatically have been treated as a reflection of his parenting ability. By all accounts, he has consistently ensured that his children are fed, clothed and cared for, and there has never been an opportunity for him to demonstrate his abilities as a single father. It appeared that considerable support was made available to the mother to support the children whereas equal emphasis was not placed on advocating for the father’s capability to parent independently. The impression left was that key arguments surrounding his parenting strengths and the distinction between relationship issues and parental ability were not pursued with sufficient force. Given the seriousness of family proceedings and the impact on both parent and children, a more balanced and robust approach would have been expected. Overall, the representation observed fell below expectations, and it is understandable that an appeal is now being pursued.
